<p>Introduction<br />
In late June of 2003, I received an e-mail from Daniel Harris, who introduced himself as maritime lawyer from Seattle. He had found me through the internet and was asking me whether I was interested in helping arrest transshipped cargo in Dalian. I was excited about the task and I surfed Dans website [http://www.harrismoure.com] and learned Dan owns a small international law firm in Seattle, called Harris &amp; Moure. I replied to him immediately and sent him some relevant provisions concerning cargo arrests under China legal system. He was very happy with my prompt and helpful reply and we soon were working together on the case.  He later told me he was so impressed with my responses that he had picked me over numerous other lawyers throughout China.<br />
Brief of the case<br />
OOO Bolshoretskoe is a Russian fishing company that sold 400 Tons of pollock worth around US$700,000 to Alimex Seafood A/S, a Danish company. The pollock was scheduled to be transshipped from Dalian to Europe. Alimex had not yet paid Bolshoretskoe for the product. Bolshoretskoe owed Daxin Petroleum Pte, Ltd., a Singapore fuel supply company, around US$400,000 for fuel.  M/V IVAN POLZUNOV, the vessel carrying the pollock, was scheduled to call on Dalian on 4 July, 2003. Our task was to seize the pollock for Daxin to get Bolshoretskoe to pay its debt.<br />

<p>Accidents are unexpected occurrences in life. These are traumatic events that nobody wants to encounter. Because of the shock an accident causes, people tend to lose their ability to think correctly resulting to serious injuries, even death, to himself or to another party.<br />
How can we overcome shock during or after an accident Presence of mind is very vital in situations like this.<br />
There are several kinds of accidents. Examples are vehicular accidents, industrial accidents and aerial accidents. Different accidents need different approach.<br />
Car accident is an example of vehicular accidents, which claimed millions of lives and caused many people to suffer. Damages a car accident can cause include disability, emotional distress and permanent disfigurement. A lot of victims endure from injuries such as broken bone injuries, scar injuries, head and neck injuries, and nerve damage.<br />
We cannot do much during an accident because it happens so fast that we are not able to control it. Take note of important visual information, like scratches and marks on the car and the weather condition. If you do not have pen or any writing materials, review the scene in your mind so that you can remember it. You have to tell the police exactly what happened. Take pictures of the cars involved in the accident. The picture must tell a detailed story. If you feel any pain or discomfort after the accident, consult a physician right away, or else it will raise questions whether the injury was caused by the accident or not. Consult an attorney before filling out any documents or giving your statement. Photograph wounds that heal quickly, you might need it during a case hearing or investigation. You have been in a accident, automobile, slip and fall, workplace, etc.. Should you see or speak with an attorney<br />
As far as I am concerned, the answer is always yes.<br />
When should you consult with an accident attorney You should seek the advise of an accident attorney as soon as possible after the accident. Do not wait. You could be giving up certain rights. You should definetly speak with an attorney before speaking with the other sides insurance agent, adjuster or attorney.<br />
You say that you can not afford an attorney. Most accident attorneys will consult with you for free and, if they take your case, will handle it on a contingency basis, not taking any fee untill the case is settled. Most settlements are increased to cover the cost of the attorney and therefore normally the attorney costs you nothing. Many attorneys will also advance all court costs for you if they are forced to file suit.<br />
You say that you were injured, however, the insurance company has offered to pay your medical bills and you do not feel it is right to take advantage of them by asking for additional money for your, pain, suffering, lost work, etc.. Dont you feel that you as a person are worth something Do you think so little of yourself that you feel that your pain, suffering, inconvience, etc. is worthless. You did not cause this accident. What you are going through was caused by someone else. You deserve to be compensated. The insurance company, as a matter of good business, has already built these types of costs into the premiums that they charge their customers. If the money does not go to you it will probably go to their shareholders or to increased salaries or . Why shouldnt you be properly compensated. Remember most good attorneys are ethical and although they will attempt to obtain as much money for you as is due, they will not take your case unless they feel that it is proper.<br />
You say someone else admitted liability and said that their insurance will pay all your damages. Thats great, however, what if the person changes his or her story later on and says that you were at fault. Or what if the other sides insurance company refuses to pay what you think is proper. In fact, how do you know what is proper Remember, an insurance company may pay claims, but it is in business to make money. It normally will not offer one dollar more than it has to and if you are not represented by an attorney the insurance company adjuster or attorney may feel that he or she can "get away" with paying much less than the claim may be worth. Additionally, what people state at the time of an accident is not always what they state after having spoken with a friend, insurance agent or attorney. Finally, an insurance adjuster or insurance attorney works for the insurance company, not for you. How do you know that what they are telling you is correct or true. Remember, in most instances, they are there to try and save the company money. You need an attorney on your side to tell you what your rights and obligations are.<br />
You say that you were not hurt that bad or at all. How do you know how badly you were hurt. Some injuries do not show up for months. Other injuries may aggrivate a prior problem. Even if you have been found to be "ok" by a doctor, how do you know that a problem will not come up later. If you have insurance and did go to a doctor, who is going to pay your co-pay or deductible. If you do not have health insurance, who is going to pay for your examination which should include xrays, etc.. If you retain an attorney he or she can probably refer you to a doctor who will accept a lien against the insurance settlement, thereby saving you from paying money out of your pocket.<br />
You say you have accident insurance, why not let them handle everthing for you. Your insurance company is there to defend any claims against you not to represent you in any claims against other parties. Additionally, they also are in business to make money. How do you know if they are trying to settle a case to help you or to save themselves money.<br />

<p>The state has a monopoly on behaviour usually deemed criminal. It murders, kidnaps, and locks up people. Sovereignty has come to be identified with the unbridled - and exclusive - exercise of violence. The emergence of modern international law has narrowed the field of permissible conduct. A sovereign can no longer commit genocide or ethnic cleansing with impunity, for instance.<br />
Many acts - such as the waging of aggressive war, the mistreatment of minorities, the suppression of the freedom of association - hitherto sovereign privilege, have thankfully been criminalized. Many politicians, hitherto immune to international prosecution, are no longer so. Consider Yugoslavias Milosevic and Chiles Pinochet.<br />
But, the irony is that a similar trend of criminalization - within national legal systems - allows governments to oppress their citizenry to an extent previously unknown. Hitherto civil torts, permissible acts, and common behaviour patterns are routinely criminalized by legislators and regulators. Precious few are decriminalized.<br />
Consider, for instance, the criminalization in the Economic Espionage Act 1996 of the misappropriation of trade secrets and the criminalization of the violation of copyrights in the Digital Millennium Copyright Act 2000</p>

<p>We were all taught in school that our forefathers left England to escape religious dictatorships.  Okay, there was a lot more to it then that, but it was a big enough deal that they made sure it got honorable mention in our rulebook.  They clearly made the point that we were to have freedom of religion here in America.  They also used the word "God" in some of their formal paperwork and even on our money.  I dont want to argue politics here, but rather semantics.  They didnt say "freedom of Christianity," they said "freedom of religion."  The boys who wrote up all of our formal paperwork were wordsmiths and they debated long and hard to find the perfect set of words to govern ourselves by.  It wasnt decided that we had the freedom to choose whichever form of Christianity that we liked, but whichever form of religion.  Religion is in and of itself a much broader concept then Christianity.  "God" can mean a lot more then just the Christian definition too.<br />
No, I dont agree with all the bickering and arguing over whether or not there should be prayers in school or if the Pledge of Allegiance is constitutional.  You cant stop someone from praying whenever or wherever they choose.  Nor can you force a prayer out of someone either.  Its a dumb thing to argue about and not worth being offended over either way.  I think its important to teach out children what our countrys Pledge of Allegiance is, but I dont know that its right to force anyone to state a pledge, especially children.  Seems a bit dictator like and kind of like brainwashing.  Teach them what it means.  Teach them what prayer means.  Teach them what making a pledge of any kind means whether its a pledge of ones allegiance to their countrys flag, a pledge of fidelity to a spouse, or a pledge of loyalty to a boss.  But also teach them that in this country we have the freedom to make pledges or not.  Teach them that in this country we have the freedom to pray to whoever or whatever we like and the freedom not to pray.  Teach them just how important that freedom is.<br />
Im saddened when I hear of Pagans being persecuted for their spiritual beliefs in this country.  Did the Sunday school teachers forget to mention that using the colors green and red for Christmas is Pagan  Did they mention that Christmas lights, yule logs, and wreaths are all Pagan  Did they mention that almost every single Christian holiday is celebrated ironically on top of a Pagan festival  Why do you think we have bunnies, baby chicks, and pretty flowers as part of our Easter celebration  Because it coincides with the Pagans celebrations of Springs renewal.  From what I can see, Pagans arent all evil ugly witches anymore than all Christians are white supremacists.<br />
I dont have a deep knowledge of all of the different religions of the world, but I can tell you that it doesnt take much research to see that theyre all very much the same.  Get past which church uses which secret handshake and which rule book you should follow, and you find that theyre all teaching us to respect each other, to love each other, to conduct yourself with honor, and to be good to the planet and animals that were blessed with.  The rest is all dogma and debatable.  Nobody has any real concrete proof that their particular form of God is the only one.  Whos to say that God or Jesus isnt wise enough to visit more than once using different names and different forms  Wouldnt it make sense given the size of the planet that the rest of the world would need to be given a fair chance at knowing about God too  Is Buddha so very different from Jesus  Their teachings are incredibly similar.  Why limit God to a concept that only fits what your particular culture or region of the world knows about<br />
Another thing that always puzzled me is why prophets and seers are allowed to channel holy books and tell of the Messiahs coming, but then were told by the churches that being psychic is demonic  It seems a bit contradictory to me.  Every psychic Ive ever met lost power over their visions if they werent acting in the highest good.  Most of the psychics Ive met believe very deeply in a form of God or some sort of a higher magical loving guidance over us.  Theyre visions into the other side created that belief.  Theres nothing quite like chatting with the All-Mighty to make a believer out of you.  Isnt prayer in and of itself a form of telepathic psychic connection with the other side<br />
It just seems to me that if we quit arguing over what words, labels, and names we give these concepts and quit arguing over methods of prayer and such that wed see that were all so much more alike then we are different.  Ive known three different Catholic men who fell in love with the Buddhist faith because it so beautifully highlights the teachings of Christ.  I really believe that is what were meant to do.  All of the holy books tell us to love one another.  You cant truly love someone if you dont take the time to really get to know them and what they stand for.  Shouldnt we learn about each other from a place of love rather than from a place of judgement  Nobody can prove that anyone elses religion is wrong and nobody can prove that theirs is right.  Too many translators over the course of history to be able to be 100% sure about anything any more.  We cant really assume that the others are completely wrong and we cant assume that our own religion is completely right.  Religion and God is so much more than we can fully understand at this time.<br />
